Regulation on Rental of Residences for Tourism Purposes and Airbnb Law

“Regulation on the Regulation of Renting Activities of Residences for Tourism Purposes” Short-term housing rentals via Airbnb and similar platforms will now be governed by new rules and regulations. While this regulation, published in the Official Gazette on December 28, was expected to come into force on January 1, 2024, allegations were raised in the public that the implementation of the regulation was postponed for 1 year. This comprehensive regulation requires homeowners to obtain a permit and imposes severe criminal penalties on those who do not meet these requirements. This regulation, also known as the Airbnb law, is considered the beginning of a new era in the tourism industry and brings with it important questions for business owners stuck in zoning legislation. 1. New Regulation and Effective Date:

New rules and regulations were introduced for Airbnb and similar daily residential rentals with the “Regulation on the Regulation of Renting Activities of Housing for Tourism Purposes” published in the Official Gazette on December 28. These regulations were expected to come into force on January 1, 2024.

2. Claim of Postponement of the Law:

According to public reports, it is claimed that the implementation of the article of the law regarding the rental of residences for tourism purposes has been postponed for 1 year.

3. Regulation Published in the Official Gazette:

The regulation regarding daily rental and Airbnb houses, which has been discussed for several months, was officially published in the Official Gazette.

4. Permit Document Requirement:

According to the regulation prepared by the Ministry of Culture and Tourism, it has become mandatory to obtain a permit for apartments to be rented for less than 100 days. Some conditions must be met for houses to be rented daily, otherwise penalties will be imposed.

5. Regulation Process and Penalties:

  • Citizens who will rent will need to obtain a permit from the Ministry of Culture and Tourism.
  • In case of rental without a permit, an initial penalty of 100 thousand TL will be imposed.
  • If the permit is not obtained and the rental continues, the penalties are expected to increase to 500 thousand TL and then 1 million TL.

6. Enactment of the Law and Zoning Legislation Problems:

  • After the enactment of this law, also known as the Airbnb law, business owners who will receive a tourism license have encountered problems with zoning legislation.
